    MARRIAGE IN THAILAND

    I.     BEFORE THE MARRIAGE

     

    Belgian nationals who wish to marry another Belgian national or a Thai national in Thailand are kindly requested to contact the Thai authorities (‘Amphur’) to verify the exact requirements they need to meet in order for their marriage to take place. At the Amphur, you will learn which documents you need to submit and if they need to be legalized or translated.

     

    The Thai Registrar at an Amphur office usually requires from Belgian nationals an “Affidavit for marriage” that must be made in person at the Consular Section of the Belgian Embassy in Bangkok, and a “Certificate of no diriment impediment”, i.e.an attestation from this Embassy that according to the Belgian law there is no Belgian legal caveat to the marriage of the Belgian national.

     

    The following documents have to be presented at the Consular section of the Embassy of Belgium in order to obtain the “Certificate of no diriment impediment” and the “Affidavit for marriage”:

     

    1)                By the future Belgian spouse

     

    1.1             If you currently reside in Belgium or outside Thailand

      • 1 Photocopy of the bio-page of the Belgian international passport + all of the immigration stamps for all entries into the Kingdom of Thailand
      • 1 Photocopy of Belgian identity card
      • 1 certified full copy of the birth certificate that is issued by the Belgian municipality where you are born Belgium. Only an original document  or a certified full copy can be accepted, no photocopies, fax or e-copies. This document cannot be older than 6 months
      • Certificate of nationality, residence and civil status. This document is issued by the Belgian municipality (or Embassy) where you are registered. Only original evidence will be accepted, no photocopies, fax or e-copies. This document can also not be older than 6 months.
      • Please note that the local authority request the name, surname and address of two Belgian citizens, living in Belgium and being informed of the future marriage in Thailand (copy of their identity card). Therefore you have to provide this information to this Embassy.
      • Please note that the local authority asks proof of your monthly income. Therefore you have to provide this information to this Embassy
      • Important: if you are divorced or widowed, you will need to submit documents to prove your status (recent extract of your divorce act, death act of your former spouse)

     

    These documents do not need legalization.

     

    1.2.          If you are registered at this Embassy

     

      • 1 Photocopy of the bio-page of the Belgian international passport + all of the immigration stamps for all entries into the Kingdom of Thailand
      • 1 certified full copy of the birth certificate that is issued by the Belgian municipality where you are born. Only an original document  or a certified full copy can be accepted, no photocopies, fax or e-copies. This document cannot be older than 6 months.
      • Please note that the local authority request the name, surname and address of two Belgian citizens, living in Belgium and being informed of the future marriage in Thailand (copy of their identity card). Therefore you have to provide this information to this Embassy.
      • Please note that the local authority asks proof of your monthly income. Therefore you have to provide this information to this Embassy.
      • Please note that the local authority asks proof of your House registration for an Alien (yellow book) issued by the Thai city Hall. Therefore you have to provide a copy of your house registration book for an alien to this Embassy.

     

    These documents do not need legalization.

     

     

             

    2)    By the future Thai spouse

     

      • 1 Photocopy of the bio-page of the valid Thai international passport (if available);
      • 1 Photocopy of Thai identity card.

     

     Procedure

    ------------

     

    Please note that this Embassy cannot always issue the documents immediately and that in some cases needs to submit applications to the Ministry of Foreign Affairs in Brussels. In such cases, the issuance of the certificates can take several weeks.

     

    In case the application is complete and the legal conditions are fulfilled, the Embassy will issue the 2 documents Affidavit for marriage” and “Certificate of no diriment impediment”. The Embassy will legalize your own signature on the second document. The consular fee for the issuance of the two documents is the equivalent of 20 euro, to be paid in Thai Baht at the current rate.

     

    Translation and legalization

     

    You will need to have both documents “Certificate of no diriment impediment” and “Affidavit for marriage” translated into Thai by a translation office recognized by this Embassy (list at your disposal at the counter of this Embassy).

     

    Both documents must be also legalized by the Ministry of Foreign Affairs of Thailand (Department of Consular Affairs, Legalization Department), Chaeng Wattana Road, Laksi District, Bangkok Province 10210.

    II.     THE MARRIAGE

     

    You can contract your mariage at any Amphur office (District Office) of your choice.

    The registrar will register the marriage and issue two documents:

     

    • a Thai Marriage Certificate;
    • and a Copy of Marriage Registration Book.

     

    III.     AFTER THE MARRIAGE

     

    These two documents must be legalized by the Thai Ministry of Foreign Affairs (see address above) before they are translated in the official language of the municipality of the Belgian spouse by a licensed translation office (list at your disposal at the counter of this Embassy).

     

    Make sure that the documents and its translations do not contain any errors (mistakes in name and civil status happen often).

     

    The original documents in Thai and their translations must be legalized by this Embassy (you have to pay for each document the equivalent in Thai Baht of 10 Euros).

     

    Once in Belgium you must inform your city hall of your marriage in Thailand and change in your civil status as soon as possible. You may ask your city hall to make the transcription of this Thai Marriage Certificate in the registers of the civil status of the city. This will allow you to obtain certified copies of abstracts of this marriage directly in Belgium, without having to apply to the Thai authorities.
