    Family-reunion visa (Long Stay visa)

     

     

    1.  Family reunion with a non-EU/EEA spouse residing in Belgium

     

    Who can apply?

    • The embassy in Kampala only takes applications from:
      • Ugandan nationals 
      • Family members of recognised refugees in Belgium
      • Foreigners holding Residence Permits issued by Ugandan Immigration
      • Refugees holding official refugee status documents issued by Uganda
      • All other nationals must apply at the embassy responsible for their country of origin

    Note:

     

    a) This is not applicable to the spouse of a polygamous marriage if another spouse is already in Belgium

    b) The applicant and the person to be joined must be above 21 years of age

    c) The minimum age is brought back to 18 years when the marital bond is preexistent before arrival from abroad to Belgium of the spouse holding a Belgian residence permit

    d) No family reunion is possible for the spouse of a non EU foreigner, who him/her-self has already been allowed to reside in Belgium as a spouse of a Belgian resident

     

    * Documents to be submitted: 

     

    1 application form and 2 pictures.  The application form must be signed by the applicant

    Valid national passport (valid not less than 1 year)

    q      Residence permit (ONLY if you are not a Ugandan national).

    q     Copy of identity card/residence permit of the person living in Belgium (front and back)

    q     Certificate on non-criminal record (from Interpol Kampala for Ugandan nationals)

    Proof that the applicant is free of diseases that may endanger public health: medical certificate available at the embassy

    Legalized copy of the applicants birth certificate

    Legalized copy of the marriage certificate  

    If applicable, legalized copy of a judgment of divorce or death certificate of ex-spouse

    Proof of sufficient lodging (to be obtained at the 'administration communale/gemeentebestuur’ in Belgium)

    Proof that the foreign national in Belgium has a valid medical insurance covering him/her and the family member(s) joining.

    q Proof that the foreign national in Belgium has sufficient, stable and regular financial means to support himself and his family and will not become a burden to the government;

     

     

    Family Reunion for child of a non-EU citizen

     

    Who can apply ? 

    • Child of a non-EU national admitted to reside for an unlimited period in Belgium or authorized to be established there
    • Child of the spouse of a non-EU national admitted to reside for an unlimited period in Belgium or authorized to be established there

    Note: 

     

    a) The applicant must be celibate

    b) The applicant must be under 18

    c) The non-EU national in Belgium/parent or his/her spouse must have legal custody of child

    d) In the event custody is shared both parents have to agree

     

    * Documents to be submitted:

     

    q       1 application form and 2 pictures.  The application form must be signed by the applicant

    q       Valid national passport (valid not less than 1 year)

    q       Residence permit (ONLY if you are not a Ugandan national).

    q       Copy of identity document/residence permit of family member in Belgium

    q       Proof that the applicant is free of diseases that may endanger public health: medical certificate available at the embassy

    q       Certificate of celibacy

    q       Legalized literal copy original of the birth certificate and if necessary, any document establishing family ties

    q       Parental/custodial authorization of the parent(s) not accompanying

    q       Proof of sufficient lodging (to be obtained at the 'administration communale/gemeentebestuur’ in Belgium)

    q       Proof that the foreign national in Belgium has a valid medical insurance covering him/her and the family member(s) joining.

    q Proof that the foreign national in Belgium has sufficient, stable and regular financial means to support himself and his family and will not become a burden to the government;

     

     

    2.   Family Reunion with an EU citizen

     

    If the member of your family is Belgian or a national of a country of the European Economic Area (including the Member States of the European Union + Iceland, Norway, Liechtenstein)  

     

    Who can apply? 

     

    • Spouse (must be above 18 years of age)
    • Descendants of the above-mentioned person ( must be below 21 years of age)

    * Documents to be submitted:

     

    • 1 application form and 2 pictures.  The application form must be signed by the applicant
    • Valid national passport (valid not less than 1 year)
    • Belgian ID and Passport (both sides) of your family member in Belgium
    • Residence permit (ONLY if you are not a Ugandan national)
    • Proof of sufficient lodging: to be obtained from the town hall of the place where your family member resides in Belgium;
    • Proof that your family member in Belgium holds a medical insurance covering himself/herself as well as yourself.
    • Proof that your family member in Belgium disposes of stable, regular and sufficient income (last 3 salary slips or last income tax assessment paper from the tax department in Belgium)

    For the spouse:

     

    • An authentic Marriage Certificate issued by the Registrar of Marriages
    • If applicable, a Divorce act  or Death Certificate explaining the relationship with the previous spouse

    For children:

     

    • An authentic Birth Certificate issued by the local, competent authorities
    • If applicable, a Death certificate if the other parent is deceased
    • Authorization from the guardian: the signature of the spouse who delegates parental authority allowing the child to travel

     

    Important Remarks:

     

    All official non–Belgian documents have to be legalized originals.

     

    This means:

     

    - Legalization by the Ugandan Ministry of Foreign Affairs then legalization by the Belgian Embassy

     

    If necessary these documents should be accompanied by a certified translation towards one of the following languages: French, Dutch, and German.

     

    - The official documents have had to be delivered within the last 6 months.

    - The Embassy can require the production of additional documents.

    - Within the framework of the examination of request for visa of family reunion, the Foreign Office can require a DNA test. 

    - These instructions serve as a brief information on the Belgian immigration law, which remains the legal basis according to which the visa application will analyzed.
